Terms of Service
Effective May 20, 2026
These Terms govern your access to and use of the FixTheCall service (the "Service") operated by Quality Amusement, a sole proprietorship owned by Mitchell Estes and located in Tulare, California ("we," "us," "our"). By creating an account or using the Service you agree to be bound by these Terms. If you don't agree, don't use the Service.
1. The Service
FixTheCall provides AI-powered automated text and voice response to missed phone calls on behalf of service businesses (HVAC, plumbing, electrical, amusement route operators, and similar trades). The Service includes a dashboard, telephone routing, AI conversation engine, and operator notification system.
2. Your Account
You must be at least 18 years old and legally able to enter into contracts. You're responsible for everything that happens on your account, for keeping your password secure, and for the accuracy of the business information you provide. You may not share your login with anyone outside your business.
3. Billing & Trials
Every paid plan starts with a 14-day free trial. Your card is captured at signup but not charged during the trial. On the 14th day after signup we automatically charge your card the monthly plan price. You can cancel any time before that 14th day to avoid charges, in the Manage Billing area of your dashboard.
After the trial, you are billed monthly. You can cancel at any time. Cancellation takes effect at the end of your current billing period — we don't prorate refunds for unused days. Unpaid invoices may result in account suspension.
SMS and voice usage above generous fair-use limits on your plan may incur a small overage fee, billed monthly. We'll always tell you before charging overages.
4. Customer Messaging & Carrier Rules
You agree to comply with US carrier rules including TCPA, A2P 10DLC registration, and CTIA messaging principles. Specifically: you only message people who have opted in (calling your business counts as implicit opt-in for the auto-text-back), you honor STOP/UNSUBSCRIBE replies immediately, and you do not send marketing content through the Service unless a recipient has explicitly opted in to marketing. Violating these rules may result in suspension and is at your own risk.
5. Acceptable Use
You will not use the Service for: illegal activity, fraud, harassment, impersonation, sending malware, scraping, reverse-engineering, or any purpose that would violate the carrier rules in §4. We reserve the right to suspend or terminate accounts that violate these terms or pose a risk to other users.
6. AI Output Disclaimer
FixTheCall uses large language models (currently Anthropic Claude) to generate replies to your customers. AI output can be wrong, incomplete, or unexpected. You remain responsible for the accuracy of any commitments your AI assistant makes on your behalf. We recommend reviewing transcripts regularly during your trial and configuring trade-specific prompts. We are not liable for revenue loss, customer dissatisfaction, or other consequences arising from AI output.
7. Data & Privacy
Customer conversations (texts and call transcripts) are stored in our database and visible to you in your dashboard. We do not sell your customer data. See our Privacy Policy for full details.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.
9. Termination
You can delete your account at any time from the dashboard. We may terminate accounts that violate these Terms, with reasonable notice when possible. On termination, we will delete or anonymize your data within 30 days, except as required by law.
10. Changes to These Terms
We may update these Terms occasionally. If the changes are material, we'll notify you by email or in the dashboard before they take effect. Continued use of the Service after changes means you accept them.
